In the light of reform proposals from the Law Commission of England and Wales, Stephen A. Smith (St Anne’s College, Oxford) suggests that the third party rule (the rule that only parties to a contract can enforce the contract) is a fundamental feature of English contract law. Article published in Amicus Curiae - Journal of the Institute of Advanced Legal Studies and its Society for Advanced Legal Studies. The Journal is produced by the Society for Advanced Legal Studies at the Institute of Advanced Legal Studies, University of London.
