Contract Law – The Law Commission’s proposals on privity

In the light of reform proposals from the Law Commission of England and Wales, Stephen A. Smith (St Anne’s College, Oxford) suggests that the third party rule (the rule that only parties to a contract can enforce the contract) is a fundamental feature of English contract law.
