Against both originalist and liberal, "living" constitutional approaches that predominate in American jurisprudential debates today, Thomas Jefferson's attentions to the contingency and fragility of textual interpretation illuminate an alternative historical framework: one oriented around allowing for the possibility of putting fragments of authoritative textual inheritance to new use.
